TERMS OF SERVICE
LAST UPDATED: April 10, 2026This contract applies to the artist, hereinafter referred to as the Seller, and the person or institution, hereinafter referred to as the Client, who purchases a work of art, hereinafter referred to as the Product, from the Seller. By ordering the Product from the Seller, the Client agrees to the following terms and conditions:PAYMENTS
1. The Client agrees to pay the full amount in advance for any orders of $250 or less.2. For orders above $250, the Client agrees to pay half of the total invoice amount in advance. The other half must be paid after approval of the initial sketch.3. Any other payment schedule must be mutually agreed upon before the commencement of production of the Product.4. The Client accepts that production of the Product will not begin until payment is received by the Seller according to the schedule above.5. Certain types of work do not allow for payment in installments. In these cases, the Client will be informed and asked to agree to a different payment schedule before production begins.PRODUCT DELIVERY
6. The Client agrees that the Product will be delivered digitally via a drive link to the email address provided by the Client, after the Seller receives final payment.
7. Any other delivery method, whether digital or physical, must be mutually agreed upon before work begins. The Client is obligated to bear any costs incurred by alternative delivery methods, such as postage costs, material costs, digital service subscription fees, etc.
8. It is the Client's sole responsibility to propose a delivery method that works for both parties. The Seller cannot be held liable for the Client's loss of access to the delivery method, loss of delivered files, impediments such as spam filters, or any other technical obstacles beyond the Seller's responsibility.
8b. After delivery of the product, it is the Client's responsibility to store it properly. Loss of the product due to negligence will not be reimbursed by the Seller. The Seller cannot guarantee that the original copy of the product will be available if the Client loses their files.REVISIONS
9. The Client is entitled to 5 full revisions during the sketch phase.
10. The Client is entitled to 3 minor edits after completion, such as changing eye color or correcting a small detail, up to an additional 10% of the total time spent creating the originally delivered Product. Any requests above this, however minor, will require prior mutual agreement and will result in a proportional increase in the order value. Any such increase will be invoiced separately. Work on any excessive requests will not begin until payment of the additional invoice(s) is received.CURRENCY CONVERSIONS
11. The Client agrees to pay the total amount specified in USD.
12. The Client is entirely responsible for any currency conversion costs, bank transfer fees, payment provider service fees, and any other costs involved in transferring funds to the Seller.REFUND POLICY
14. The Customer has the right to request a full refund if there is no progress for two consecutive months or when the Product is not completed within four months. Refund conditions for orders requiring more work must be agreed separately before the start of work. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident, or any other proven reason for the interruption of work.15. The Customer undertakes to contact the Seller quickly and efficiently, promptly responding to any requests for comments, clarifications, opinions, validation of progress, etc. Failure to communicate promptly by the Customer will be considered as implicit approval of all work progress and the current state of the Product.PERSONAL AND COMMERCIAL USE
16. The Product received by the Customer is intended for personal use. Any use of the Product for commercial purposes, resale, reproduction, or publication for purposes other than personal use must be previously approved by the Seller. This will require a separate agreement between the Client and the Seller, defining the exact conditions and financial implications of such use of the Product.The Client does not have the right to use the product in any blockchain-related technology, including NFTs, cryptocurrencies, or future inventions in this area.Furthermore, the Client does not have the right to use the product for AI datasets or for AI tools and any present or future inventions in this area.CANCELLATIONS
17. The seller reserves the right to refuse or cancel any order, with a full refund, without needing to provide justification to the client.18. Any disrespectful behavior will not be tolerated and may result in the cancellation of the order. The client will receive a full or partial refund, depending on the amount of work already completed. The seller will have the right to refuse any service to the client in the future.
